I. General Terms and Conditions

1. Terminology Used in the Terms and Conditions:

1.1. authorisation - verification of personal identity in the internet bank or by using the electronic signature of the Latvian State Radio and Television Centre (LVRTC) or Lattelecom. Personal data (personal code, name and surname) shall be acquired as a result of the authorisation, which shall be further used in the site for the purpose of searching personal-related information in the database of the municipality.

1.2. e-service - service available on the internet site to be requested and completed in electronic manner.

1.3. user - individual who requests performance of the e-service in the site and who, if such is necessary upon requesting the performance of the service, shall be authorised with the means of authorisation available on the site; on the site the user may represent himself/herself or also a customer - legal entity, if the authorised representative with the signatory rights thereof has delegated representation rights to the user.

1.4. customer - legal entity, on behalf of which its representative - the user is requesting e-services; the authorised representative of the customer with signatory rights may delegate representation rights to the user.

1.5. site host - developer and technical provider of the site is SIA “ZZ Dats”, registration number: 40003278467, registered office 41/43 Elizabetes Street, Riga, LV-1010, Latvia, which is responsible for the correct technical functioning of the site and the e-service.

1.6. municipality - holder of the authorised service data, which ensures correctness of the authorised service data.

1.7. confirmation - electronic confirmation of the user to only use the site in accordance with these Terms of use of the site.

2. Upon consenting to these Terms, the user confirms that he/she:

2.1. shall only use e-services in accordance with their specifics and these Terms;

2.2. shall not use e-services for the achievement of illegal goals;

2.3. shall only use words or expressions that meet general courtesy norms upon communicating with the municipality or the site host within the limits of this site.

II. Rights, obligations and liability of the User

1. The user shall be entitled to represent itself in the site as an individual or also a customer, if the authorised representative of the customer with signatory rights has delegated representation rights to the user.

2. The user shall be entitled to request and use all e-services available in this site, which require or which do not require authorisation.

3. The user shall be entitled and also obligated to report to the municipality or the site host in the case of discrepancies or in the cases when it has revealed inaccuracies of its data or incorrect operation of the site.

4. The user shall be responsible for the authenticity and completeness of the data provided to the state registers and the municipality.

5. The user shall not allow the disclosure of authorisation data to third parties and access of these persons to its data.

6. The user shall be responsible for all activities performed by it in the site.

III. Rights, obligations and liability of the site host

1. The site host shall ensure the requirements of the Personal Data Protection Law in regard to the user.

2. The site host shall ensure the confidentiality of the user information. The aforementioned information may only be disclosed to third parties in the cases and in accordance with the procedure specified in the laws and regulations of the Republic of Latvia.

3. The site host shall be entitled to unilaterally make changes in the scope and procedure of e-services to be provided.

4. The site host shall be responsible for the correct functioning of the site.

5. The site host shall not be responsible for the damages of the user if a third party has logged in on behalf of the user or has committed any unsanctioned activities on the site due to the negligence of the user.

6. The site host shall not be responsible for interruptions in the operation of the site, which have resulted due to disturbances of electronic communications independent of the site host, as well as due to incompetent use of the site or computer hardware by the user.

7. The site host shall not be responsible for the consequences related to the conclusions, which the user has drawn from the information acquired on the site.

8. The site host shall be entitled to revoke this agreement unilaterally with immediate effect without previous warning to the user in any of the following cases:

8.1. the user violates/fails to meet these terms;

8.2. the site host has reasonable suspicions that the personal data of the user are being used for unauthorised purposes or activities are being performed, which may block and/or hinder the functioning of the site.

IV. Rights, obligations and liability of the municipality

1. The municipality shall ensure the requirements of the Personal Data Protection Law in regard to the user.

2. The municipality shall ensure confidentiality of the information on the user and activities performed by it. The aforementioned information may only be disclosed to third parties in the cases and in accordance with the procedure specified in the laws and regulations of the Republic of Latvia or in cases of clear mutual consent.

3. The municipality shall be responsible for the content of the user data under its competence.

4. The municipality shall not be responsible for the damages of the user if a third party has logged in to the e-services on behalf of the user or has committed any unsanctioned activities in the site due to the negligence of the user.

5. The municipality shall not be responsible for interruptions in the operation of the site, which have resulted due to disturbances of electronic communications independent of the municipality, as well as due to incompetent use of the site or computer hardware by the user.

V. Unforeseen conditions

1. The municipality, the site host and the user shall not be responsible for the losses, related to unforeseen or Force Majeure conditions - natural catastrophes, including fires, floods or activity of third parties independent of them - changes in the national laws and regulations, warfare, strikes, mass riots, etc.

VI. Validity of the user confirmation and termination thereof

1. The user confirmation regarding compliance with the Terms of the site shall come into effect at the moment when the user electronically consents to these terms. The confirmation shall be effective for the entire functioning of this site.

VII. Other provisions

1. The municipality or the site host shall be entitled to make amendments or additions to these terms.

2. Terms, amendments or additions thereof shall be published on the site. The changes shall come into effect at the moment when the user electronically consents to these terms.

3. Disputes or unclear issues shall be resolved via negotiations under these terms. Submission of a written claim to the other party shall be a pre-condition for consideration of the dispute.

4. If the dispute cannot be resolved via negotiations, it shall be resolved in accordance with the procedure specified in the laws and regulations of the Republic of Latvia.
